The Delaware Health Facilities Authority was created under 16 Del. C. ยง 9204 for the purpose of assisting health-care facilities in the acquisition, construction, financing and refinancing of health care related projects, including hospitals, nursing facilities, treatment centers, emergency facilities and ambulatory care facilities. It is governed by a seven member board appointed by the Governor, which meets to review the needs of each applicant.

The Tax Equity and Fiscal Responsibility Act of 1982 (TEFRA) is federal tax legislation passed in 1982 to increase revenue in the country through various measures. TEFRA hearings are mandated by the IRS to provide a reasonable opportunity for interested individuals to express their views, either orally or in writing, on the issuance of bonds and the nature of the improvements and projects for which the bond funds will be allocated.
